XTC Logistics Inc.

Any news for this one, just heard from friend carrier they are not paying bills over 90 days aging and XTC Accounts advise they are shutting down some departments or offices
 
Pepsico refused to pay saying they already paid to XTC and they cant help anymore.
I'd try again, but if that's their stance, lawyer up and get an "intent to file" drafted. Pepsico is gonna be looking at a class action if they take that approach, there are a ton of carriers looking to get paid from XTC. TBH PEPSICO are somewhat to blame too with their absolute dog sh*t rates they accept, and the issues they'ev been having paying them out.
 
I would love to know PepsiCo thinks of their little buddy at XTC today...but unfortunately they won't learn and will just search for the next cheap guy to do their bidding.

I'm sure guys like Allroutes will pick up the slack. And to be fair, the rates that XTC was giving us were actually pretty good so i dont think its all cheap but a good portion of their work is cheap and heavy.

Pepsico has denied responbillity, they want us to take the claim up with XTC...

Any news or udpates from anybody else? Should we sign a petition together and send a joint demand letter backed by mutiple carriers? Let me know and i can setup a google sheets to get this started!
 
So this is the least costly and little known way to "join" together. Most legal representatives (and court staff) are unaware that you can name as co-plaintiffs in one small claims court filing, and as long as the individual (not collective) monetary amount does not exceed $35,000 (or the excess is waived for the portion over $35,000), the collective amount of the Claim has no monetary limit.

e.g. 20 carriers owed $20,000 each = $400,000

The defendants must be common, i.e. XTC, its director, Pepsi.

There is no accounting contact anymore, they let all the employees go and locked the doors and walked away.
 
Good luck. It was painful collecting from XTC. Once all invoices were paid in full, we put them on a DNU. If it was a Pepsico load, I could have helped with contact at Pepsico for payment. Is Nulogix a Broker?

Does anyone know what even happened with XTC and Pepsi? They had majority of the freight, and now all routes has like all of it.
 
Nope but sure would not be taking it until we find out what happened to XTC going broke doing it.
I'd chalk it up to the rates Pepsico was negotiating. Especially if its the Bottling side of things. I wouldn't be surprised if XTC had to keep matching lower rates to keep the lanes, and paid out higher to the carriers hauling. Pepsico does this often where they use the cheapest rate to set the baseline on their RFQ's, and they operate like a broker, unless you are doing 10+ lanes with them none of them are contracted to you, they can choose to use another carrier over night, cancel within the hour of pick up etc. Worked for them for 2 years before we walked away from the BS. And last few months they been having payment issues even though they are NET 60. I'm sure things are a bit better on the Frito-Lay side but I'ev spoken to carriers that worked with them over there and its not much better.
