Pride Group - TPine

The part that makes me laugh, there was an article the other day about who had been awarded the contract to reposes all the equipment. They went to great pains not to mention who the trucks were being reposed from.

Apologies should have added some detail. I was asking regarding some case(s) @SCAM CHASER mentioned where Owner/Operators were treated as employees by court and director was personally held liable to pay them....Please share if anyone know for reference (news or employer name)

So the most important case was Sagaz v 671122 decided by the Supreme Court of Canada. In the decision, it outlined the 4 conditions to be considered when determining if a Dependent Contractor was in fact an employee. The Canada Labour Board uses the 4 point test in cases brought before them where no equipment is being provided by the driver. If the CLB rules (which it does in 99% of the cases) in favour of the "employee", compesation is deemed to be wages, and the employer's director is personally liable for unpaid wages.

If it is deemed that the Independent Contractor was working exclusively for the Company, and it the Company shuts down owing the IC money, backpay and proper notice of ceasing operations must be given. In Mancino v Nelson Aggregate, although ruling in favour of the defendant Nelson in interpreting that proper notice had been given, it does state that if the IC was economically dependent on the company, that notice must be given and potentially severance paid.

any news for pride and Tpine they spouse to transfer all lease to landers but they still demanding money plus some landers sending notice they took over contract and Tipne threating with bailiff ,does anyone know what they are doing and why they trying to do double dip.

Majority of tpine staff has been let go. Remaining staff will be there until closing in March. They will be looking to open up truck sales on a smaller scale next year, from what I heard.

I wonder where their going to get stock from?
 
i heard most of landers picked up units and send to used truck sale dealers and ,brand new trucks sent to oem dealers ei freightliner ,volvo peterbilt selling for them , anyone go to local dealers you can see lots of pride truck in their yard and they are for sale , another hand pride selling itself too, but when you buy from pride then hard to get financing because landers don't feel safe due to scam by them . i believe they did really big scam so many trucks they bought for penny now selling for higher rates, plus TPINE still collecting and demanding money from lease holders , but in actual they cannot demand any money they must transfer those contract to real landers so lease holder can deal direct with landers , but unfortunately they are doing everything as in the past monitor ,courts and banks have no control on them ,as per court documents they must shutdown everything and pay back to landers expect logistics ,but they are still doing everything as normal ,no idea how they doing

Shady dealings, i wouldn't expect anything less from Pride
 
I thought they were closing Tpine? The rumor I heard was they were going to open up the same type of business but under a new name and on a smaller scale.
 
Yes…Tpine has to be closed by no later than March 31st. That’s when the CCAA will end.
