Speaking of LoadLink ...

That shout box is our new Used Truck Mag, don't be loading it up with freight!

It's a shame the "introduce yourself" thread hasn't been as active with the newer folks- as most folks around here seem to be of like mindedness and could benefit from relationships made on the ol' board (or not !) . I mean I don't even know who @Michael Ludwig works for!

i'ev seen this but seems cumbersome to go through a forum to and dig through posts that end up being outdated. And unless we delete the posts after every completed load that sub-forum will be full in a few months lol. It could work for something like a long term lane or project, but for daily freight posts like the LINK i dont see it being effective.

I knew about @Michael Ludwig typing novels, but the romance novels, that's certainly a new one on me. Explains why he can't answer an email before 10am LOL

Using the truck/freight leads thread isn't a bad idea... Imagine the name of the thread being the lane or state/prov to state/prov so members can review who is servicing the lane and if there are people with regular freight on them they can post that there too. Of course the states that have multiple zones would have to be posted that way (Nor Cal, South Cal, West PA, East PA, etc.).

Reminder: you can edit or delete any of your posts once a lane/project changes for you.

Just a thought, hoping you all are well,
Mike

There are several other boards if you look for them. None with the client base (both carrier and broker) that LL has. I've got to be honest, I've met a bunch of their employees over the years, they are nice people. The company offers a service that many people in transport need from time to time to supplement thier existing relationships. It's a great tool to help brokers and carriers alike expand into new lanes or cover existing business if their regular provider (or freight) isn't there. I just wonder if people harp on LL for legit reasons, or just to complain. I didn't feel the cost was 'way out of line'.

Yes, there is a cost to membership like anyting else. I forget the exact math at my former employer, but we were a high tier, including DAT, etc. and I recall it was approximately the average margin for 1 load per user per month. The service helped us far greater than the cost so it was kind of a no brainer.

For some, it's a great and helpful service, for others like Mr. Ludwig, maybe not so helpful so he's saving his cash. It's that simple.

Anyway, back to it,
Mike

Agreed ... LL does have one of the largest client bases out there, but one has to seriously question the value of that base. The LL base is where people seem to find the most liars, cheaters, and thieves.

DAT and Loadlink own by the same company. You cannot have a DAT account unless you have LL account.
Just imagine while having your coffee of the day.
134000 Carriers in Canada as per 2019 stats and let's assume 50% use LL. Each member gives them $600 on average. my calculator stopped working here..
Brokers in this forum. Does LL pays you to post loads?. I heard they pay to CH but I might be wrong
I have a broker only package with LL, $250 plus tax (in case you were still wondering).

We did one Soperma Load from Soperma Drummondville QC to Soperma Chilliwack. Dan Powerhouse Transportation sold this load to us(double brokered load) again, no they are not replying or answering the calls. We reached out to Soperma and they told us Le Groupe Xtreme was the broker for the load. We reached out to them and they are saying we have already paid to Dan Powerhouse and we cannot pay you. Even though we gave them all the proofs that we did their load.

Can you please suggest what we can do next?
Benttrans, although this may not be relevant to this thread, please see the below snippet from https://mccagueborlack.com/emails/articles/collecting-freight-charges.html

Carriers are in a particularly precarious position in cases where the entity responsible for paying freight charges instead pays a third party, like a load broker or freight forwarder, who is then expected to remit payment to the carrier. However, agency law may permit the carrier to target the entity that forwarded payment downstream by, in effect, forcing that entity to pay twice.

The relevant law in this area stems from the seminal case of Canadian Pacific Ships v Industries Lyon corduroys Ltée.9 In this case, the Federal Court of Canada dealt with a scenario in which the plaintiff carrier sought payment from the defendant consignee for freight charges. The defendant consignee argued that it was not liable, as it had paid a third party load broker which it believed to be an agent of the plaintiff carrier. When the load broker went bankrupt without remitting payment, the plaintiff carrier sued the defendant consignee for the freight charges.

Justice Addy gave full judgment for the plaintiff carrier on the grounds that there was no basis for the defendant consignee to reasonably believe that the load broker could receive payment on behalf of the carrier;10 in effect, the defendant consignee was required to pay for the freight charges twice. In resolving the dispute, the Court held that in cases where a debtor pays a third party, instead of remitting the freight charges directly to the carrier, the onus is on the debtor to show that one of the following is true to avoid paying a second time:11

  1. The carrier actually authorized the third party to receive money on its behalf;
  2. The carrier held out the third party as so authorized;
  3. The carrier, by its conduct or otherwise, induced the debtor to come to that conclusion; or,
  4. A custom of the trade exists to the effect that in that particular trade and in those particular circumstances, both the carrier and the debtor would normally expect the payment to be made to the third party.
The reasoning in CP Ships has since been applied in a multitude of cases, including in Ontario,12Alberta,13 British Columbia,14 and in the Federal Court of Canada.15 It stands as a warning to those who utilize the services of a carrier but funnel payment of freight charges through an intermediary.

If they won't help you advise you will have to call their shipper to get paid from them. If that doesn't help work call Soperma back, if they don't care I suggest scamchaser on this site to reach out to for help. Being broker I have paid twice before, part of the business and risk if you don't ensure who you hired actually moves your clients loads.

Get yourself an experienced transportation lawyer or para legal. Most will provide an initial consultation for free or a minimal amount. Make your decision how to proceed based on their advice. In the meanwhile, contact every other party involved in this mess and raise hell. Threaten to sue the shipper, the receiver and the original broker. Causing enough of a stink might shake loose a payment. If not, you might be in for a lengthy and perhaps unsatisfactory legal exercise. Reach out to ScamChaser on this site. He is an experienced paralegal with excellent transportation knowledge.

This right here has helped us twice now, if you make enough noise someone will notice and that someone sometimes is all that it takes to get your money. If you call them once they shrug it off, be persistent and let em know what actions will follow, of course, dont harass them but still get their attention. We've used a lawyer to send out letters to the shippers and consignees involved threatening legal action and that was the quickest way to get our money, within 72 hours we had the funds and it only cost us in the hundreds to recover tens of thousands.
