Hello. Can anyone assist with trying to collect payment from Sobeys or is this even a possibility? We have been fighting for a year now to collect payment on a load that was double brokered and we were the Carrier who actually completed the shipment. We put VIJ LDH into collections (that is who we got the load from) and they got the load from a Broker. We have billed the broker for the freight invoice and we are not getting paid by the broker either. Sobeys requested we remove them out of the email chain? Any advice would be greatly appreciated. Thank you

The problem with someone like Sobey's is they are aware of the law but to enforce it, it's going to cost you more than that invoice is worth and they know it.

As someone else suggested, going after the original broker might be an easier target.

Really only worth it if you have a significant amount owing, but I'm curious if you can also demand legal fees if you provide enough notice to them. @SCAM CHASER would you have any insight on this?

Take all parties to small claims court. It does cost much and it will get everyone's attention.
I would not suggest this unless you are ok with being blacklisted by Sobeys and all of the chains they own.

Go after the broker, but I am also going to say something that you are not going to like hearing and other may not agree with either but....

This is your own fault, you should have known better then to take this load from a carrier that obviously was not working with Sobeys directly and not authorized to broker their loads.

Is there a list we can get on to never have to go again? Them Lowblows can both KMA cheap and take forever to unload. Lots of way better shippers and receivers than a grocery chain IMHO.. Like just about everywhere.

I cant say I disagree with you but if I was a carrier I would like to keep the option open.
You never know.

It is always a problem when it goes Shipper>Broker#1>Broker# representing as a carrier to Broker#2>Consignee>Carrier. Only after a Claim is filed in Small Claims Court will anyone respond.
One major problem in this industry is the extension of credit especially to anyone appearing on Link. The other problem, again with Link, is that "brokers" cannot see other "brokers" postings, so a legitimate broker has no opportunity to view their load re-appearing on Link.
Another major problem is the "good broker" responding to a quickpay request. After all, if a good broker was to net $300 on a $3000 load, and accepted a discounted invoice of 3% or $90 for quickpay, they have increased their profit by 30%.
 
I'd say take it to SCC and list all the parties involved. Let Sobeys call their broker and tell them to get it resolved immediately. The original broker should have made some sort of resolution to the end carrier. You have nothing to lose.
 
I would probably take them to Small Claims Court as well. It gets people to open their eyes and you might resolve before you even get a court date. As for being blacklisted by Sobeys, well in my opinion that is not the end of the world.
 
Its very difficult to get anyone at Sobeys who will help. All contacts you can get seem to push off to anther person who never answers.

The broker led us along for months with phone calls stating they would sort it out...blah blah blah. Now, they will not respond. We have been told they reimbursed the other carriers that were scammed, but we are still waiting on payment.
Even if the broker gave us some loads, as it is apparent we can do the job, and apparently for free. That would have gone a long way with us. Build a relationship with the carrier who got stiffed, give them some good paying loads...and in the end, everyone wins.
