We worked with Moh Trucking Ltd. in Apr 2024 and received a cheque from them that returned from the bank as NSF. After this, we never got a response on our payment. Contacted their customer as well and never received any response from them. Their accounts (Tanvir) rarely reply to emails, nor pick up phone calls. Ray Gill (dispatcher or Owner) made many excuses for the payment.

Also SAFER has three Moh Trucking losted - which one did you work with .. two are not authorized and one has 35 trucks but no inspections...

Ray Gill is a crook. He built a 3 million dollar monster house and holds back carriers hard earned payments??? Guys a scumbag in my opinion. Definitely DNU

Collections are zero help in the transportation industry. I currently have hired a collection agency to handle three claims, and it has been four months and NOTHING! We even have a judgment and still they cannot collect a dime. They haven't put liens on anything, only issued phone calls. Terrible. Even contacted Baxter Bailey and they said they cannot collect on a judgement???

I have found scathing google reviews to work better than collections

You need to get in touch with a Bailiff to collect on your judgement.
 
Collection agencies look for the low hanging fruit, the easy wins. If the defendant refuses to satisfy the judgement, or the process becomes too time consuming, the agency usually gives up. They don’t want to spend any of their money going after what’s owed to you. You’re better off using an experienced, transportation paralegal. It has been my experience that using someone with actual transportation knowledge will provide a better outcome.
 
One of the major problems in this industry is credit applications (or the lack thereof). Did you ask for the debtor to complete one before you extended credit to him, and if so, did you ask for banking information? (another way is to ask whomever paid the non-paying broker, if they paid him and if so, would they supply proof (back and front of cheque). The whole idea of course is if you have accurate banking information, you can go the garnishment route.

The other route is to file for a financial hearing. The principal then has to appear and under oath, must truthfully answer questions such as where do they bank. If they fail to appear, another hearing is scheduled. If they do not appear for the 2nd hearing, you can apply to a Superior Court Judge to issue a warrant of committal for failing to appear. The judge can then issue a warrant for that person's arrest for a maximum of 5 days (first time).

In the 25 years that I have been practicing, only once did my persistence result in the incarceration of the debtor (arrested on a Friday by YRP, released Sunday night, call from his lawyer Monday morning wanting to know to whom to make the cheque payable.)

You don't need a bailiff unless you are repossessing equipment (very costly) I can give you a game plan if you like. PM me.

Unfortunately, once it goes to court and gets a judgement a collection agency can't collect on that. Now a bankruptcy, we can help collect on and It depends on what you have to collect on. But, they are a great help in the transportation industry and there's a lot of carriers that would disagree with you because they are receiving money off of debt they thought they could never get paid a penny on. Maybe it's the collection agency you chose was the problem? As with any company, If you get one that doesn't know what they are doing or they don't work hard enough or have the right tools, collection team or attorney's then you probably won't have a good experience. And no collection agency in transportation can guarantee a 100% win. If they do, they are not being truthful. We have one of the highest success rates out there and ours in only running 70%. I'm sorry you are having a bad experience.
