job applicant threatening a lawsuit against me because I didn't hire them...

Usually the less said in such situations the better i.e. “Thank you for your application; however, the position is no longer available”. He has no leg to stand on anyway, but usually employers get tripped up when they say too much.. you’re English isn't good enough..you’re too old.. too fat.. etc.
 
Crazy! Cant understand this country anymore. Pay for nothing seems like the norm. Hard work doesnt pay like it used to.

Over 20 months later I am still dealing with this guy. I should be hearing a decision in the next month or so since he has exhausted all of his opportunities to adjourn the matter.

In my case the guy suing me has legitimate mental health issues and has a history of vexatious litigation.

He had zero driving experience at the time of his application, to date, hasn't shown me a copy of a passport/admissibility into the US so wasn't qualified at the time for the job. (We do cross border work only).

He's also changed his settlement offer from $5,000, to $2,500 and then went alll the way up to $16,000 with his last offer. He's adjourned this matter 5 times and the Tribunal member finally lost patience with him, in December 2025.

I also mis-quoted earlier about his resume. It was not 6 pages of text, it was 27 (yes, twenty seven) pages of text. Rambling about his life, mental health struggles, how he hasn't been working...

He is also treating this small claims matter like a supreme court trial complete with examination for discovery. Demanding I produce "evidence" like providing internal business records like: hiring logs, employee information, CCTV footage of our business premesi. He's gone as far as to accuse me of LMIA fraud and has tried to get officials from Service Canada involved as "intervenors" in this matter.

He has no evidence I did anything wrong but when he submits submissions he goes into wildly expansive arguments (30-40+ pages of rambling) about things that have nothing to do with the case and has already told me and the CRT that he will be appealing this issue in other courts if he loses. He's also accused the Tribunal of conspiring against him so this guy really has some issues.

So, in my 11 years of being in this industry this is one of the dumbest fucking things I have had to deal with personally. Hands down.

I guess it goes without saying that this fellow is representing himself. No self respecting lawyer or paralegal would condone or recommend such antics.

This is insanity.

I had heard of this happening to larger companies, professional shake down artists essentially.

Apply for a bunch of different jobs, take an interview and if the interview doesn't follow the letter of the law or there was a violation, HR asked a question that "isn't allowed" they will extort you.

From my understanding though, the amount is often sub 1k and never goes this far.

This truly sounds like mental health and someone is desperate need of help.

Correct. He's self represented. So am I. The amount of billable hours a lawyer would rake out of this based on how he behaves would have cost me somewhere in the five figures range. I don't want to spend that kind of money. I am also not going to be shelling out money for everyone who gets turned down for a job.

No, he has some knowledge of the legal system. He says he has some paralegal experience and definitely knows a thing or two about the BC Human Rights code so he's trying to use the process to wear me down to a point where I want to settle.
