job applicant threatening a lawsuit against me because I didn't hire them...

Recently I put on a job ad on Craigslist last week for a company driver. To my surprise, we got a boatload of applicants (over 30+) and while sorting them out I had one guy reach out to me constantly.

He called my office probably over a dozen times, asked to send a resume, so he sends it.

However, instead of a resume, he sends me paragraphs upon paragraphs (probably 6 pages of text) rambling about his experience and his life and mental health problems.

I immediately decided not to pursue any more interest in this applicant, yet he kept calling me. 2-3 times a day since last Wednesday. I finally told him I was going in a different direction, I did not specify to him why just that he wasn't the right fit.

This morning he sends me a "warning" letter saying he is going to file a suit claiming is human rights were violated and I discriminated against him based on his race and mental health issues. Funny thing is, I've never seen this guy before in my life. He is demanding I hire him or pay him "reparations" or he'll report me to BC Human Rights Tribunal and the Civil Resolution Tribunal. Un fricken real....

I'm not worried, just wanted to see if anyone here has had similar experiences dealing with truly unreasonable people seeking employment.

Probably does it as his job. Just another scammer.

That's quite a story... There's plenty of whack-jobs out there eh!

I would say it's just another scammer seeing what he can squeeze out of a company.....I think these people should be beat within an inch of their life and then asked "are we good?" "you gonna keep stealing from people?"

When you think you have heard it all...

Trucking jobs are becoming harder to find in the Vancouver area, many folks aren't hiring and the ones hiring fill up positions pretty quickly or are not paying well. So I can see how it can drive some people off the edge.

However, with woke culture its becoming more common to pull the discrimination card, the courts see it all day and it doesn't go anywhere unless the concern is genuine which in your case it does not seem to be. I have had to also deal with applicants who bring that up. If you are true in your hiring process, provide valid reasoning and it doesn't have to be detailed on why you have rejected them and have that be your last contact. If the applicant is harassing you file a police report and let them know they are disrupting your daily operations by calling.

I dont think this will go anywhere, people are desperate and this seems like a poor attempt to hustle you. I wouldn't think much of it. Also if possible please send me details so we can avoid this.

this couldn't be more true. Chances are smaller companies who don't have the time or resources and are afraid of the process would rather pay and get out of the ordeal. All it takes is one to bend over and these scum bags start doing this to everyone they come across.

We always take applications and always say upfront, in writing "only qualified applicants will be pursued" this protects you for any kind of future legal issues.
 
The nerve of him was something else.

Frankly, I am not OBLIGATED to do anything for him during the hiring process. He wasn't even an employee, he did not receive an employment contract. He just tried telling me his sob story and figured he'd be automatically entitled for employment. If it goes anywhere you bet your bottom dollar I'm going to see him in court I wont pay him a penny.

Until you receive something official from a government agency, you shouldn’t give this situation anything more than a laugh and a giggle. A “warning” letter???? Even a letter from a “law firm” or paralegal is basically toothless in this case. If you have broken some sort of Provincial labour statute or regulation, they will be the ones wanting to discuss it with you. A waste of your time!
 
In Ontario, all you need to do is accommodate an applicant should they need special consideration if they are granted an interview.

We have made arrangements for people applying from out of town to interview via Teams/Zoom,
We have an operational elevator to get people from the parking lot to the boardroom for interview,
We have allowed an applicant to bring their interpreter during an interview.

Those are the kinds of things that are mandated (and there are many more), not a guarantee of employment. How could you operate if you 'had' to hire anyone that walks in the door? Impossible.

This shakedown is sure bullshit.

When he started SpaceX he was told in no uncertain terms by the U.S. government, and many of its law enforcement agencies, that he could not hire anyone that was not a permanent resident of the United States or he would go to prison if he did.
Fast forward to the Biden administration, and Elon musk is informed by the U.S. Government that he must hire asylum seekers (not permanent residents yet), or he will go to prison !!!
