I'm just guessing here but I assume the way the corps are structured leaves them with no liability.
I doubt that they were in on this scheme though, they have always seemed like stand up guys to me.


As far as I'm aware I think all the unpaid loads delivered to Metro...

Following up on this thread to see if anyone in the network has any updates. This situation remains a major priority for us, particularly as we have already incurred significant legal expenses on top of the unpaid services rendered.

To summarize, we are owed several hundred thousand dollars by FA International. Although we successfully secured a favorable court judgment against them, the company has ceased communications and apparently vacated their known operations.

We would greatly appreciate any intelligence regarding their current whereabouts, assets, or whether they are continuing to operate either directly or via indirect corporate entities.

It may be too late, but your legal team should have included the Canadian parties on the BOL as per the federal Bills of Lading Act. You may have been able to get a judgement against those parties which may have more weight for payment. If you only went against FA International as a company, you would have to ask your lawyer regarding next steps to find any assets owned by the company. This is highly unlikely because what does a freight broker own with any value - just a bank account, which I am sure is completely closed out by now. Your lawyer can make a different claim against the director(s) of the company for failing to maintain a trust account as per the Ontario Highway Traffic Act since they are located in ON. You may get a judgement there but monetizing it might be another hurdle.
