The letter was dated Jan 2024 and so much has changed in the industry since then. If the bank has partnered with them in January to support their cash flow they should have everything caught up. Maybe you should have a phone conversation with Brad Barges to follow up.
Brad Barges cannot be bothered to respond a single email. This gentlemen lets his staff handle all the phone calls regarding payments. I had the President of our company request a phone call from Brad, and Brad didn't respond nor be bothered to call. We shared our concerns with PepsiCo.

Hey guys, we did a load for XTC back in April. Long story short, we weren't aware of their financial situation at that time. Our factoring company denied the invoice, So we billed it to them directly. At that point, we were told that payment terms are 45 days. Ever since we delivered the load, they stopped answering our phone calls and stopped replying to us via email. I reached out to the shipper to see if they could help us, and they just pretty much told us that they can't do anything, since our contract was with XTC. Is there anything we can do in this situation? Would appreciate any advice you can offer since XTC seems to be out of business now. Thanks in advance.

This is where they are wrong, any lawyer worth their salt would be over this. If you havent been paid the shipper will have to pay. Was this Pepsi by any chance?
 
I don't think so. We picked up from Diageo Canada in Amherstburg, ON going down to Gluckstadt, MS. Commodity was Alcoholic Beverages (Crown Royal).
