so in theory- Company A hires Roadchain to move a shipment, Company A pays Roadchain for the service, Roadchain files for bankruptcy due to other customers bankruptcy, carrier does not get paid by Roadchain, Company A is liable to pay carrier? Company A in theory gets shitted on by paying twice?
As I understand it... Yes.

"Company A" may have to pay for the load twice...

Unfortunate for "Company A", but a good protection built into law for carriers...
 
See attached page - this is a complicated bankruptcy affecting Super Pufft Foods as opposed to Super Pufft Snacks.
Super-Pufft Snacks LTD was listed as a creditor owed money as well. I have not looked into the relationship between Super-Pufft Snacks LTD and Super-Pufft Foods LTD.

I'm surprised they are an 'unsecured' creditor... Wonder if there is another list out there with 'secured' creditors... Usually the parent company has a large secured debt owed to them in case of a bankruptcy...

That was the case when our customer went under... Several individual shareholders and the parent company were listed as secured creditors for large amounts, leaving the rest of us poor bastards to wait around for just the scraps...
 
In this case the unsecured creditors are 8.7MIL, and secured creditors are 1.5MIL. The funny one about this bankruptcy is that there is no inventory, no assets, no anything but 450K cash on hand.

So, basically there is nothing left for the unsecured creditors once they pay out the secured creditors... That sucks...
 
That is almost always the case when an entity goes to bankruptcy. It is usually the secured creditor that forces bankruptcy by petitioning the court to bankrupt the entity to ensure that there are still some assets available to cover the secured investment.
In the case of ROADCHAIN nobody has pushed them into bankruptcy so the owners will just suck the company dry until there is nothing left to take.
 
Why do insurance fraud in the GTA? Why scam TTC employee benefits? Why sell NFTS? Just make a brokerage company and bid lower, register yourself to a PO box! Tell everyone you have 110 net pay. Whatever you double broker within the 110 days is yours to keep! Next, stop of in Montreal and then Halifax after that. Incorporate multiple times!

Fraudulent, criminal operators have been around for years and will probably continue to plague our industry for years to come. The best, and perhaps only defence against becoming one of their victims is constant vigilance and a thorough and religiously applied vetting process. In order to keep rats and other assorted vermin out of your house, you must ensure there are no cracks allowing them to get in. Giving someone credit is the same as lending them your money. Be as careful extending a company credit as you would handing over a few thousand dollars in cash. We can bemoan and gripe about lax and ineffective bankruptcy laws but avoidance is the best defence.
