Maybe they did check and just didn't care ?!?!?!
The load moved and they got their cut. What do they care if you got paid or not?
The few good brokers out there (a number of them on here) must just cringe in horror every time they hear stories like this. It gives them all a <insert appropriate politically correct descriptor here> eye, and makes it just that much harder for them to do their perfectly legitimate, honest business every day.

True, seems like it after having conversation with them. I was very surprised because most of the broker do react and take actions. They don't want anyone to reach out to their client as they will look bad and effect their business off course but surprisingly they didn't care. Going through legal way now, hiring a transportation lawyer.
 
And the other thing you are doing is formulating, writing, putting into practice, and enforcing a policy which details exactly how your staff are to deal with load broker loads from here on in, right ???
Two advantages of such a policy ... 1) It keeps you from getting stung again, and 2) Good brokers have a lot more respect for you for your diligence.
The only disadvantage of such a policy is your trucks might wait a little longer for loads ... but at least you will know you are going to get paid for the loads you do haul.

Yes, it's a big learning lesson and we are trying to enforce these policies so we don't have to waste our time chasing the brokers/shippers for our money.

I have been screaming about this for years, for both carriers and brokers. Develop and religiously enforce a policy that tries to ensure you are dealing with legitimate suppliers/customers. Take a page out of the proctologists play book and have a long, deep look into their nether regions! Even with an iron clad policy, the occasional rat will still squeeze its way in and throw a wrench into a shipment. However a thorough, consistent policy of checking out every available aspect of a new partner will reduce your exposure to bad debt, service failures, loss of a good customer and all the other nightmares that can plague our industry. As Michael correctly said, good brokers have no problem with a carrier asking questions about their payment history. Hell, the real good ones like to brag about it anyways!

Now, The Xtreme Group threating us that they will sue us if we contact their customer lol as it affects their relationship with the customer. I don't know how they are thinking that they will suppress our voice. We have paid our drivers, fuel and truck expenses, why we should not ask for the payment for the service we have provided. So unethical.

squeaky wheel gets the oil, keep going keep calling. If they truly spoke to their lawyers they would know BOL Act is Federal

Yes, they are. I never expected this from them, they reacted like nothing happened and double brokerage sounded fine to them. Their President sent us an email saying it’s between you and the carrier they sold load to. Don’t bother us otherwise we will sue us for destroying their relationship with Soperma.

Everyone is all that until shit goes south. I wouldn't be afraid of the empty threats. They sold the load and should of done the due diligence to check if it was double brokered or not, it's not that hard folks.

Might be why there is a change in policies / tones used to carriers. If I remember correctly, they were pretty professional, in the past. Having said that.....been a while I didn't have any interactions with them so.....either they changed because of the market, either they changed because of the new ownership or the workers there are new people and don't care at all. Maybe the bosses doesn't even know about this and the person being contacted is a dispatch who's trying to do a power trip? Just brain storming.

I do have a past history of working on one of their load and it was okay(no complains) But they reacted completely different when we brought up this thing, basically they don’t want to take the responsibility of what happened and don’t care that their load got double brokered. I was so surprised to see their President’s Maxime Belanger email(Trying to threaten us) where he said you have no right to contact shipper to be paid and if it affects more my relationship with my customer then you will be sued for our loses(lol how about our loss). The way they are dealing with this situation is very unprofessional and unethical, I worked with Traffic Tech on a similar situation and they were amazing.
