Freight held hostage
The law does not allow you to hold onto freight associated with one contract because of non payment for a previous contract. Although this does allow you to demand COD or pre payment ,as payment terms.
I once did this with freight belonging to one of Tera Kiping's new companies with freight , identical to the freight , we had picked up for the same shipper and consignee, months earlier, which we got shafted with while she was with Wheel King. She had no choice but to pay up, and on our terms. Delivery was delayed until payment was in hand.
While I was working for Maisliner back in the late 90's we held a clients freight for non payment of a previous bill. We were forced to release the freight when the Police showed up, and explained the clients rights and that charges could be laid againts us.
What works well is that you advise the client that his freight is still in transit and that you request payment for it. You accidentally re routed his freight elsewhere. Say from Montreal to Vancouver and would keep him abreast of the situation. Try to delay delivery and get him working.
This of course is a tactic of last resort, you have already decided that you will never work with this individual again!!!!
