Just wanted to let everyone know that Vertex Transport Ltd / Ranpreet Singh owner/ Armaan Bhatia dispatcher, will not pay for damaging freight be careful as you could holding the bag for claims.
Unethical company who doesn't deserve to be in business. Lies after lies and now apparently they cant afford to pay $5000 for their deductible for over a year because they are "financially strapped" drivers, carriers be careful with people like this its only a matter of time until they screw everyone and disappear with your money
 
Question: You are dealing with this company as a carrier, they damaged your customers freight while in their possession, and you are having a hard time completing the claim process? I ask as you posted in non paying freight broker forum...

Contact everyone…..their insurer and your insurance provider. Failing to honour a legitimate freight claim because it falls within a carrier’s deductible is simply BS. You might also want to engage the services of a paralegal who is experienced in transportation, Scam Chaser on this site is an excellent choice.
 
I do not understand - them not being able to pay their deductible should not affect your claim. If they had valid insurance - then your insurance comapny gets in cotact with MPI - they insure everyone in MB - and they pay you out ... as a result the carriers insurance may be cancelled ...
 
Unfortunately there are still a few carriers, who when faced with a legitimate freight claim that falls within their deductible, will simply choose to ignore it. They are hoping that you the broker and your customer will give up and absorb the loss yourself. When faced with a reluctant carrier such as this, your best bet is to enlist some professional legal advice.
 
I have found that insurance companies will pay out an insurance claim that falls below the deductible and demand the deductible from the carrier. You have to request it and state that the carrier is unwilling to deal with it. It is in the carrier's best interest to pay these small claims out and leave the insurance company out of it and its baffling to me why the carrier didn't take care of it. On the other hand, @SCI may be in trouble if they didn't formally submit their claim to the insurance company under the 9 months to which the carrier got away with a sneaky move and may have won that battle.

Insurance claims are not a tough thing to manage but the key is to get resolution quickly. If it doesn't progress as expected it is important to include the insurance carrier and get a claim number within a couple days so you don't end up in a mess like this.
 
Take them to small claims court.. it's a small amount.. likely they'll ante up if they see you're serious about going to court, and you may remind them that a judgement on their file isn't a good thing for their business to have.

That option is useless. They can just declare bankruptcy and start up under another name.

You'd think they would just pay it and move on.
 
Do you not have broker insurance? yes it will cost you 5k for the claim but thats why you have it, for carriers who don't have cargo insurance or refuse the claim, your agent would deal with MPIC on your behalf... I would never go without it, plus the customer can sue your BN and if your the owner they can go after you personally...

Small Claims Court is useless. Even if you win, it can be appealed to a real court and it could take you years to get paid. Best off selling the debt to a collector and have them go get it.

No one is going to throw their business into bankruptcy to avoid paying a very small debt. Collectors can't do much other than harass.. and best case scenario you only collect a part of it as the collector, of course, needs to be paid as well.

Actually, if you have a 5000 dollar debt, you sell it for 1500 to a collector. If that collector tries to collect 5000.00.
 
Collectors are all bark no bite.. Better off going to small claims.. a higher court is unlikely to overrule a small claims decision that is clearcut.. i.e. where carrier simply ignored paying their deductible... on what basis would the small claims decision against the carrier be overruled?
