They still are in business and I would suggest that if you do not get paid then do the bill of lading act. That always seem to work.

I believe they declared bankruptcy. Carrier I know received papers in the mail last week I think.
 
They are done.

Received a nice letter from the president - Linda Earle-Barron stating that all their receivables were factored and there will be no monies coming into the company for disbursement to the vendors
Also attached a copy of their payables outstanding showing amount
owing of over $679 000.

They also sent us a copy of a letter from their landlord indicating the lease was terminated.

We tried for over two years to get paid -only received a partial payment.

Doesn't a bankruptcy involve alot more than a letter from the company President saying "We can't pay our bills"? If it was that easy anyone that ever struggled with paying their bills (either personal or business) would have qualified for bk.
 
Your are absolutley right Ralph....they may just be shutting the doors and seeing who comes after them.....go hard and you may get it as they don't want to pursue the issue with lawyer.
 
Didn't Dave Neeb formerly of CANCO fame (now Frontier in Kitchener/New Dundee) pulled this exact stunt when he transferred his assests to JBT's name as I recall?

If a debtor tries to pull this stunt/caper who can force them into bankruptcy? What are the costs if any and what are the ramifications if any?

No pot to piss in

It costs money to go Bankrupt! You only file for bankruptcy when you need to protect your personnel assets. If you got nothing to protect even the pot you piss in why spend the money. Go after her clients you did the work for, by her not going bankrupt makes her clients responsible. Thats the way I would go!
