So long as the checks clear.. who really cares.
Trust account operations are very complicated from a legal standpoint. If it can be shown that the trust account (even if not identified as such) had general funds also deposited into it, it then loses its "trust" applicability.
Some of you may recall the GMAC case where the Ontario Court of Appeal, among other things, stated that funds collected by the bankrupt broker were not subject to the legislated trust provisions as the funds were co-mingled. Those funds received after the date of bankruptcy and collected by the Receiver and were statutorily required to be kept in a trust account by the Receiver and did satisfy the legal definition of a trust, and the claims of the owed carriers took priority over the secured creditor.
The above only occurs when the defaulting broker declares or is put into bankruptcy.
If the defaulting broker is not placed into bankruptcy, courts have found the principal to be personally liable for the trust funds.
 
Rules and rates are changing again for the BMC-84 bond.
For new Canadian brokers, I'm hearing about requirement of $25k in trust, for the insurer to offer $75k in bond.
We still have a program that offers the full $75k bond without any trust or financials.
 
That's a big list and this bond doesn't cover any shipments to Canada anyways. It is getting very restrictive for carriers to claim against these brokers.
How can I file a claim against a Brokers Surety Bond? We were not paid for freight delivered to Sobey's (Cargo picked up in QC and delivered to AB). The load was double brokered, and the Broker has dropped off the face of the earth. They were communicating with us prior, but has since ceased all communication. Simply trying to get paid for completed services. Any direction would be helpful, because I tried to file a claim against Mango Insurance who is the Insurance Company for the Carrier who fraudulently double brokered the load, and Mango Insurance is not replying. They replied to my google review though lol.
I would like to file a claim against the Brokers bond, I know I won't get anywhere with the Carrier who brokered it to us.

Can anyone recommend a good company that specializes in Surety bonds for Canadian transportation brokers.

I've noticed an extreme increase this year. just looking at different options.

We buy our bond through the TIA (Powered by Avalon Risk Management). I will see if I can find the invoice

Per their website All TIA members are given a premium discount on the bond but of course you have to be a TIA member and pay that fee

Yeah, it doesn't work on domestic cargo.

Tell them that you will reachout to Sobey's about your unpaid invoice and let others know who this broker was.

I'd be calling Sobey's.

Worst case you make a direct connection to Sobey's freight and make up the loss quickly.
