NEED ADVICE

HI I will try and make a long story short... we booked a load from Miami to Calgary picked up started moving. asked broker for all the customs and turned out it was bonded but on their bond so that worked out but while enroute out 120miles north of Jacksonville I call the reciever to make delivery appointment and tthey inform us that it was supposed to go to Calgary. So i call broker and he said he would get back tome a few hours later they tell us its supposed to go to ontario..we are western based and this is on a tuesday. they also then tell us they are only paying us from the Miami to Ontario leg and nto any reroute from Calgary to Ontario. the broker refused to pay so we said we are not delivering to ontario we will take it to calgary where the original address was and you can figure it out..they start threatening us with all sorts of stuff...finally some guy from their office phones and says ok we will honor original price so no rate compensation but we have to deliver asap as there is a crane waiting. he sends us the confirmation with no number on it but i follow up with email with the rate and convo details. we get the shipmetn delivered on Friday my guys drive empty to CAlgary to go home and on Monday the broker phones threatening us that they are not paying for anything more than the miami to ontario leg and they reneg on their conversation on friday. thoughts? also i have spoken to end customer who was equally frustrated but super unhelpful.

What does the B/l show as the delivery address? Did the local confirmation and the rate, say Miami to Calgary? Also, is the freight prepaid or collect? In cases like this, the Bill Of Lading can be your best friend, if it has been filled out properly and completely.

  1. Doesn't tell you it's INBOND. Are you even a bonded carrier?
  2. Doesn't tell you which port it is INBOND to.
  3. Doesn't know if it's going to Calgary or Ontario
  4. Says anything to convince you to do something you were not expecting.
I'd wonder if the broker will pay you at all. I'd continue to talk to the end customer to see if you can get a middle ground conversation going. Most likely he paid top dollar and this snake is trying to keep more than was he originally was intending to.

the BOL said Calgary... and when we got to ontario they had never cleared the Bond for Buffalo it was still cleared for North Portal.

I agree this broker really is a POS ... he even had some guy call us say he is a lawyer and we must deliver... and I told him if you are a lawyer why dont you demand accurate paperwork LOL
 
Yup, a pos for sure. You might consider going up the food chain at that broker, maybe you’ve been dealing with a low level flunky, and someone higher up may be able to get it straightened out for you.

Whenever someone threatens me I respond formally and in writing, and I cc my (fictitious) law firm, “McGuffy, Samualson, and Klein”. ..a couple of Jewish names in the mix for added cachet. Usually that does the trick..no overt threats..just a not so subtle hint at pending litigation should the matter not be resolved to my satisfaction. It does work!

You took a huge risk. I understand they made a mistake, but for me, you made it worse.
I mean, just run the miles, Miami to Calgary, and then to the Correct destination ON.

I am sure things would be much easier if you chose to go back and SAY NO, we don't go to Ontario.

If this was a US Broker, 80% of them don't know what a bonded shipment is, so you can never completely count on them.

Yes, as per the initial post. The trouble started at 120 miles out.
If all the trouble started after only 120 miles into the trip, perhaps returning the load due to the change in destination and then arguing about some much smaller time and distance charges would have been the best course of action. Hindsight doesn’t help though, a

definitely agree with you would have done things differently if i had known they were going to pull this. but this is where i am now.

picked up at the PORT and there was no indication that they were going to pull this until much further into the trip.
 
You said you spoke to the end customer.

It sounds like the freight is still in your possession? I would start negotiating with the end customer directly.

Edit - NVM I see that you ended up delivering it. I think I'd still start negotiating with the end customer.

Let the customer know the broker has 30 days to pay the agreed upon rate and in the event of short payment or non payment you will be seeking the difference from them plus also contacting the shipper and receiver seeking payment, assuming they are not the customer.

Also tell the broker you will file a claim on their bond in the event of non payment or short payment. Once you do any of the above you can expect a freight guard so make sure the email address you used to register the MC is active and keep an eye on it, and the junk / quarantine folders, so you can respond as there is a very short window for replies

In my experience the bond doc specifies a general geographic route the truck has to take and FL to AB vs FL to ON would not be compatible, just curious if you violated the terms of the bond.
