Insurance claim procedure

Hello peeps

I am looking for some advice about a situation I have.

In 30 years, I have not had this happen.

We are a broker and we hired a carrier I'll call " L" out of Quebec.

They loaded for us in North Carolina and were involved in an accident in New York.

I was given all the information that I asked for so I had no reason to be suspicious, until now.

The report from the carrier was that the driver was involved in an accident. The tractor and trailer are damaged and the freight might be as well.

The carrier advised that their adjuster will go to New York and advise.

Two weeks have went by. Today I call the carrier and his voice mail keeps coming on. In fact the regular message is not there, just some unintelligale mumble and then disconnect. I tried the number 3 times, same thing. My dispatcher calls *67 and they answer right away. Claim the person that knows everything will call me back.

In the meantime, i decide to call the tow company and see if he has picked up his tractor, trailer and my clients load.

The tow company was very helpful and yes indeedy my load is there.

The tractor and trailer are damaged and yet not the product on the truck. This guy claims he has viewed the goods and they appear fine, except there may be one section that has a damaged piece or two.

He says he offered to offload the goods to inspect them, but he was told that a salvage company will be coming to pay the bill and take it all.

I have since left a message for his insurance broker to call me direct.

Why would the insurance or carrier NOT be interested in crossdocking the freight onto another truck and filing a damage for only the damaged items. The tow company says he can facilitate and offered the dock and facility to accomodate us.

Is there a scam going on? Should I send in my own carrier to take the freight from the trailer if situtation gets shadier. Do i have a right to?

I am so confused.

Perhaps, arrange to cross the dock the freight to another carrier of your choice and confirm with the carriers inurance company that any additional charges applied will be charged against their insurance as IM sure your customer is expecting this freight from 2 weeks ago.

Unless the complete recovery bill has been paid you may not be able to do that. The tower will want to keep everything to ensure he gets paid.
 
I would call back the tow company and they could give you the contact of the adjuster. If you call the adjuster and tell them that you want to pick up the load immediately and will claim for damage and transportation costs, they will not have a problem doing this and the truck and trailer will cover the cost of towing and storage so that should not be an issue. Everyone involved should be happy because by the sounds of it the Trucking Company L is saying the load is a right off and want the cheque for it.
