Sheriff – Broker – Robber
I am, truck driver, BG was beaten and robbed on 07May2010 by a sheriff in city Stony Mountain, MB. Licence plate of his car was CDA 063, Wayne.
Beginning.
Wayne, the freight broker Morguard Logistics Inc., Winnipeg, MB saw our posted truck on Link Portal Site called and offered his load and sent e-mail confirmation to deliver that load from Everett, WA to Winnipeg, MB for 4400CAD. I asked factoring company about credit history of this broker and acceptance.
When factoring answered that they don’t have their history, I asked for broker’s references, broker sent, but factoring was not satisfied to accept this broker. After that, the broker was offered a condition: broker must pay before delivery, because broker’s credit history was not allowed to give him a credit. Wayne agreed to make a direct deposit to GlobalEx account when truck will arrive and Receiver confirm by phone.
Received a confirmation to sign, my Dispatch found the standard fraud trick used by wild brokers: in the place of delivery has been written ,,To be confirmed” and “see Bill of Lading”. In connection with this, Dispatch wrought into confirmation “Winnipeg MB”, and sent a signed confirmation to the broker.
After receiving the Shipper’s data, I loaded this load and requested documents to go through customs.
I agreed with this and loaded the machine, and drove to the US/CAD border, knowing from the broker that machine was already cleared by customs. ……Then it was discovered that the machine must be delivered to Ashern, MB , but not to Winnipeg, MB. Ashern is 116 miles away from Winnipeg. Plus, from that city I have to go back to Winnipeg empty. There is additional distance minimum 230 miles, that must increase cost for delivery for minimum $600, because this is oversize load.
Wayne told me that he did not know about Ashern, he thought it was Winnipeg, but that there is a possibility still to unload us in Winnipeg, so I should not worry. This is just the beginning of the chain deceptions by the broker.
I asked increase amount of $500 for delivery to Ashern, but Wayne did not agree with it. Then I told that I will delivery the machine only to Winnipeg. Till last moment he did not want to tell address of unloading place in Winnipeg and pushed to delivery to Ashern.
After that Wayne began to assert that to unload the machine in Winnipeg it will cost for him $500 as sum of $300 ( Receiver dropped price if unloading in Winnipeg) and $200 ( to rent ramp). So, he told that he agrees to unload me in Winnipeg with $250 deduction from delivery rate. Also he told that he will not have a time to make a direct deposit because he has to come, accept and unload machine by himself, he can bring a check. For all this he was refused and statement that I will not unload the machine before I got certified check for $4400. After that Wayne told “OK”.
Also, he put another condition, that if I will not come to the place of unloading before 14:45, he will leave.
Arrived at the place of unloading at 14:30, city Stony Mountain near Winnipeg, I was surprised by the absence of the ramp and the broker. Broker arrived at 14:50 and tried to start the engine of the excavator almost an hour to make a ground/soil ramp……
After unsuccessful attempts to start the excavator, he asked me to back up to the ditch where it is possible to align the level of the deck of the trailer and the road. Having back up the trailer in half way, I realized that the trailer can fall under the ground and sit on the frame. The broker push me to make back up more, with assurances that he will look to avoid the problem occurred. Trailer and Truck got stuck in ditch.
After that a “Crazy” broker decided to unload an oversized dump truck weighing 50,000 pounds and the distance of 1.5 meters from the trailer to the ground. If he would do it, then the trailer and cargo would have been damaged.
I asked the broker to give me a certified check, as I delivered the cargo to the site. At the first, he did not agree, but after he realized, that I will not give up the cargo without a certified check, he brought envelope and payment receipt where I must sign. He gave me receipt first to sign that I received a check, he got the answer that I will sign only after I will receive a check. Only after that the broker gave me an envelope where it was a regular company check. I said to the broker that without a bank draft I will not unload and not allow to touch the cargo and remove the chains.
He took out a sheriff’s star in black leather wallet, said that he is a sheriff and has the right to do what he wants. Knowing from experience that the Russian-policemen lawbreakers have told me the same thing, I left the sheriff at the scene and took my blackberry phone, decided to make a pictures of the sheriff’s acting.
When Sheriff saw that I was making a photo, he started shouting, “- Give me the camera, I'm the sheriff, lie down, this is an arrest”, grabbed my hand with force, pushed me against the truck, push to the ground and forcibly pulled the blackberry out of my pocket, accompanying his actions with unprintable words.
Then he sat in his car with the license plate number of CDA 063, and left. After several minutes, sheriff-broker called to my dispatch, lied that on the place of crime it was not him, but his representative and the driver hit his representative by shovel.
I called the police. Police officer J. Slobodzan came and listened to my story. After that he called to the broker’s office, where he was told that the driver attacked broker representative and hit him with a shovel.
Police officer J. Slobodzan, from Manitoba, is investigating file # OC100501753. When he came to the crime scene, he was acting as if he came to remove a cat from the tree instead of a crime scene.
Before arriving to the crime scene he had the number of licence plate of the offenders car. However, he was not interested in any evidences. Even after Wayne lied by phone that I attacked with a shovel, police officer was not willing to take the shovel, which was lying in front of the truck as an evidence.
Subsequently, police officer Slobodzan begun explained that there were no witnesses, and may charge me against as if I supposedly hit sheriff by shovel.
IMAGINE A SITUATION: DRIVER HIT SHERIFF BY SHOVEL AND AFTER THAT SHERIFF LEFT,
especially, when body weight of the driver twice smaller than the body weight of sheriff.
On the next day, police officer said that it was not a sheriff, was not a broker, it was a mechanic.
Specialists know the reason why policeman, having a plate number of the car of the offender who made a robbery, don’t look for him and don’t make a report to a special police department about crime made by sheriff.
The fact is, that all the time, the broker tried to deny that he was by himself there showing sheriff ID.
On the next day, during call to police, after all the fact that the forcible robbery crime was committed under the cover of arrest, and sheriff badge, the police officer said that unfortunately there were no witnesses and will be helpful to write an explanatory note.
This was a very serious crime. The policeman was not willing to take the expertise of a shovel to check if there were any traces of the broker-sheriff-robber’s clothes, did not want to take the examination of my clothes to check for traces of sheriff’s DNA and traces of the mud which he rolled me in. Why he did not, you can guess.
About an hour after broker-sheriff left, the owner of the company to which I delivered dump truck arrived. He arrived with a trailer to reload a dump truck. Owner offer to pay by his check for the delivery.
When we were trying to pull out my truck, chain broke the radiator of my truck, then was called tow truck.
All repairs and services of tow truck cost me 2798 CAD.
If in Canada, the sheriff has the right to do whatever he wants, please let me know and I'll write a letter to the Parliament to write this law in the Constitution.
If the inspector at a scale, after the driver's comments about the illegality of his actions has the right to tell a truck-driver, that if he wants, he will find anything in the truck and will call to all other scales that there also will check the driver, please let me know and I'll walk out of this profession.
If Canadian police officers, as well as in Russia, Zimbabwe, Uruguay, have the right to cover the sheriff’s crime, please let me know and I'll talk about this all over the world.
