First Carriers (Brampton) - VTL Transport (Mississauga) - Continental Freight Movers (Oshawa)

If the shipment originates or terminates in the US, the party brokering the load, whether it be a broker or a carrier, must be in possession of a Property Brokers Licence and maintain a 75K surety bond as a condition of that licence. If the shipment is strictly within Canada, anything goes. If a carrier has to pass the load over to another carrier for completion, one would like to think that the ethical course of action would be to advise the original broker of his intent, and to obtain their consent. Not too sure how many times that actually happens in the "real world". A competent freight brokerage should monitor customs documents to ensure that the carrier crossing the border is the same carrier they tendered the load to.

That case is still pending in the courts. I was reading an article on it today. That is also about a load of stolen freight not a freight bill.
 
An interesting read economy. Demonstrates the real dangers and potential massive liabilities of a double broker situation. A risky proposition not only for the original broker, but their customer as well. As I have said previously, if you are a broker, deal only with bond fide, competent carriers and avoid the temptation to participate in co/multi/whatever you want to call it, brokerage arrangements.
 
I recently was involved in a case whereas an owner operator had not been paid by a carrier in ottawa

An owner operator contract existed between the two parties

He was insured and played under the carrier.

The courts found that the carrier had brokered the freight to the owner operator and he was able to win at trial.

The shipper and receiver were responsible for payment Despite their payment to the carrier.

I. Elieve the carrier closed its doors prior to the trial.

So I always suggest, when in doubt make payment into court
 
I agree. I worked as owner operator for about 6 companies before i go on my own. One company in laval and one company in Oaville never paie my last checks. I su one time in Montreal court and later to Court forOakville. I win the case as the huge say i was end driver entitled to the payment. In both case, they were force to paie me and i did get paie. I don't want mention name but not these companie On another note, i did 6 shipments with VTL and they give me the quick paiment. Now i do mainly Montreal to Toronto and i have 3 truck my own.
 
This whole thing is crazy. I posted on Continental a while ago, they called us on a few loads from PQ to BC. Claimed they had daily availability, but always answering on cell phones, using different names for themselves. It didn't smell right, but their price for the work was cheap! Still didn't go for it. When it walks like a duck... we called their references, and they too sounded fishy. Too much praise for a company with no D&B history or confirmed address or link credentials. We need to turn down offers of service from people like this. Say no. Due diligence is key. We all want to give people a shot, but not when they can't offers the basic information required to feel confident in a new service provider or customer.
Anyway, I hope these guys get what's due and the people owed can collect from the actual broker/customer.
Keep the postings going all. This is how we protect ourselves from the next group trying to do the same old thing (outright theft).

In the world of most reputable carriers and brokers, double-brokering is breach of contract. While it's not a criminal offence, it's poor business practice. Yes, you can circumvent and pay the carrier directly.
 
When in doubt, turn the other way. My business will be given to carriers who pay the end carrier. Im starting to this TNT Transport (True North) is connected, Im postive Kurt (Sal S) called on one of my loads.
 
We gave True North a load to the East Coast. The day after it delivered, they were pestering us for payment. Something seemed fishy. Checked the BOL and sure enough they double brokered the load. When I questioned him about it, he assured me that he uses the carrier in BC "all the time" and "has paid them many times before". I then called the carrier in BC (Sran) who said they had never heard of them until this load. Even more fishy, was the fact that True North was willing to accept less money from us on a Quick Pay than they were paying Sran. Needless to say, we are paying Sran directly to ensure they are paid. True North even called our shipper who told them where to go. They seem to be pulling this scam on large dollar loads to the West Coast or East Coast.

Note that QCT Inc's FMSCA profile in Florida has the same mailing address as CFM
 
We were recently contacted by a company called Thunder Bay Logistics / 2424759 Ontario Inc for a shipment from the GTA to the West Coast of Canada.
VTL Transport had/has the same operating authority as this company. Just to let everyone know.
 
We also received at call from VTL last week on a posting. Not sure what name they use on the link, but they're still scavenging. Caution to all.
