Question , we got mixed up with a scammer , brokered a run out to carrier , then got 2 more times re brokered . We sold it for 1800 . The carrier who actually hauled the order wants us to pay his agreed rate with scammer of 2500 dollars . Now has our customer involved with a demand letter . (scammer doesn’t care what rate he pays as he has no intention of paying it). And this has all gone done in less tha 40 days of hauling load . (Red flag) At this point don’t trust anybody involved they might all be scammers . No idea how to prove who really did the load

Whose name appears on the Bill of leading as “the carrier”.?Does the actual carrier have a properly signed, original B/L? Is there any video or photographic evidence at either the shipper or receiver that shows the carriers truck? Continue your negotiations with the actual carrier. If you offer them your original rate of 1800, they will probably accept. This does mean however that you have paid twice. Although the Federal Bills of Lading Act, and the Provincial Mercantile Act usually results in the actual carrier receiving his payment, it is not absolute and there are exceptions. For the best and most current advice in this type of matter, consult with an experienced, transportation paralegal, such as ScamChaser.

If I am reading this correctly, you are the original broker? My answer is based on this.

Talk to the shipper. See if they have any record of who came to pick up the load. Driver name, security footage etc. Truck/trailer number can help as well.

Larger shippers almost always have some sort of sign in system. Most drivers will put the company they actually work.

Receiver is another option, less likely they recorded who did the delivery but still possible, depending where it went.

Whoever is demanding payment though, is most likely the real carrier in my experience.

hopefully you didn't pay the scammer and can just pay the real carrier
 
Definitely speak with the shipper to see if they have pics/video of who picked it up. If it was the carrier demanding the 2500.00, I would have a nice convo with them basically saying that you both dropped the ball here (i.e. lack of vetting) and see if they will be reasonable. Not sure the lane/market value, but if 2500.00 is sky high, they likely know this and may accept a more reasonable amount (1800.00 or closer to it). Lastly, can you name the scammers involved here for all of our benefit so we can steer clear?
 
My recommendations would be to look into the details of the BOL. Make sure the proof of delivery can be called a Bill of lading. In Quebec, in order to be called a BOL and bring the full effect of double payment, there has to be informations contained onto the BOL. Like carrier name, and some clauses has to be on it. If not, there is no recourse on you from anyone. Carrier is responsible for taking the load from a bad apple and he should eat it. I claimed this onto Baxter Bailey last time and although they gave me a full lecture on how i will lose and they will take it to courts, i have not seen them since then. I think the carrier name on the BOL is the contractual link that causes these re-payments to happen, so if they are not named on it, there is no proof that stand in courts, in my opinion and there is a good chance they are involved in the scam as well. Dont let yourself fall into paying 3 times! I feel for your red flag. It is an indicator to me that they are are trying to scam you before the actual real carrier shows up for payment. Good luck
 
My thoughts. you hire carrier x, if you have SOLID proof of double brokering,(cam/BOL/POD) to carrier Z would result in $0.00 payment to carrier X and pay "real" carrier original rate confirmed. BIG BOLD LETTERS on my agreement now. Big US company load was pimped out 4 times. Just how we play here in Alberta!

I've had a few dealings with Bluehorse and all have been great. Including a power only where he fixed a customer's trailer for us.

Curious to learn more about this, holding a load hostage for 25 days is serious

These guys just offered us a load, also out of Houston going to Edmonton and I just cancelled it after reading this. However, The Blue Horse Trucking who sent us the tender is based out of Rocky View. Adress on carrier setup package does match with addresses in in email chains so I am wary.
