Has anybody had any luck collecting on a default judgement??

I have gotten one on Key Motor Freight and need help implementing it.

Collecting on a judgment

I'm assuming you obtained judgment at small claims court. If it was a default (they didn't show up) judgment, serve them with a demand for payment in satisfaction of the judgment.

If they don't pay withing 30 days, then go back to court and obtain a garnishee to serve at their bank. You will need their banking information. Don't forget to include per and post judgment interest. The bank has to honor it.

I am pretty sure that the bank info I have is out of date and they have closed there bank account long ago.

Can I go after the directors of the corporation as these monies should be in a trust account??

You need to file for the judgment first (if you haven't done this). This can only be done if there has been no response to your plaintiff filing or no settlement conference date provided. You will also need to complete an Affidavit of Service (8A form - 2 copies - no charge) and a Request to Clerk (9B form - 2 copies) with your Default Judgment form (11B - 3 copies - $35).

I would ask around for bank info - see if anyone else is currently receiving payments from them. It will cost you $100 for the garnishment. Call their references on the credit application they originally completed with your company - they may have the info.

Good Luck
