I agree it's a touchy subject. The bogies were slid at the scalehouse. If the driver isn't comfortable with the way the shipment is load he shouldn't be leaving the shipper.
 
Yep, we've all been here before.
Shipper points to the driver (who did nothing but back in and close the doors after loading), carrier points at the shipper who made/palletized/loaded the freight.
In the end, it would be fantastic if all loads over 40 000 lbs were scaled after loading to verify weight distribution. Some carriers actually do this for heavier loads and get reworked when there are issues (we ask the shipper to cover driver time getting reworked and it's always approved). We usually recoup the carriers costs and usually the customer is understanding about the charges. It doesn't make holding your freight hostage the right thing to do though. I hope this gets resolved peacefully.

It would be interesting to see the axle weights from the scale ticket. The shipper is responsible for loading the trailer but it is ultimately up to driver to make sure it is legal - which means scaling the load. After that it is pretty cut and dried if the driver did all he could by moving the axles/fifth wheel then it is up to the shipper to rework the load till it is legal. Yes the cost to the trucking company would be billed back.
 
Both are equally responsible, Dispatch must advise drivers the weight of shipment so they confirm with shipper upon loading. It is all about how you train your drivers and dispatchers about these easily preventable issues. I understand you cannot call and tell every shipper how to load your truck. I have shippers double stacking 35k leaving half trailer empty. Like trucking, shippers or loaders are rookies too, so in the end, it's all about training and knowledge.
They should not and cannot hold up your freight like this. getting a ticket on 40k is more of a driver or trucking company issue.
 
It’s the drivers fault . That is why the MTO or DOT gave the ticket to him . Not the shipper. He should have checked the bol. Then go scale before getting caught . Also check his weight gage on the truck or trailer . At the end of the day, the driver has all the power to be compliant. After his ticket, the company will get cvor points or safe stat for over weight . Why? The Owner is not in the truck but his driver. Why should he or she be responsible for that . It’s just the way of chain of command . If you can blame the shipper then that would be awesome! I think lack of training on the trucking company is the issue.
