Sam is an ass, no doubt about it. But if the delivery address as noted on the BOL differs from the one on your confirmation, then you should have followed up on that prior to delivery. Having said that, though, doesn't excuse Sam.. he is also responsible for this, and he too should have had the foresight to follow-up with you and to clarify the discrepancy between the order and the BOL. His tone is unprofessional. Given the small amount of money involved you might be best off to move on, and don't work with him again.
 
I am not gonna move on for a $275 deduction on an ltl shipment. Driver still has to get paid, the shipment was not "blind" just a regular ltl shipment. My guess would be they want to use their own trucks to deliver as they told the receiver they have a fleet of trucks. This does not excuse the driver oversight but it does happen, was not done on purpose.
 
If I had a dollar for every time the BOL differed from the confirmation - and the BOL was correct - I would be sitting on a beach instead of at a desk. ADCO should have told you that there was going to be a discrepancy between the confirmation and the BOL.
That is a huge deduction and not acceptable in my books.
 
I agree, not acceptable. But for $275 dollars, what are you going to do? If he short pays you then what.. you're going to court for $275.00? There's really not that much you can do other than to move on. I guess there's small claims court, but that would involve a lot of time spent on your part that could be more profitably invested elsewhere.
 
Well, payment terms are collect, I am sending a letter to the consignee, regarding the deduction, I gave "I am Sam" at adco a notice of this and gave him my personal number to respond to me, he choose not to and I did indicated my intentions.
 
Hit him where it counts... advise you will haul direct for this shipper or that you will contact other brokers/carriers with this sales lead.. Sam, being the asshat that he appears to be, probably doesn't have a lock on this customer.
 
What about picking up the freight and bringing it to Adco's dock? Service as agreed should entitle you to full payment.

Sending a carrier a $25 confirmation for anything other than a local GTA misspick (and even then it's light) is ridiculous. We're all in this (transportation) to make a FAIR profit for contributing our piece of the puzzle, this chopping down payments to suppliers with any excuse, for random amounts without it being agreed to in writing and signed by both parties is both illegal and sad to hear. Sam however gets big pats on the back (I'm sure) for all the profits he makes. Where will he be when carriers stop taking his loads because of this unethical practice?

That being said Paul, did you offer him a smaller amount for the oversight and he decided to be excessive? Could you come to a more agreeable terms?

Yep. Send your truck back to the receiver to pick up the goods and take them to ADCO. I would love to see Sam try and explain that one to the shipper and/or receiver!!! Or better yet, you explain to the receiver why you are picking up his shipment!! LOL!!
 
Paralegal already working on it, Adco should will have to do there own explanation they being taken to court over $300 plus filing fees etc.

just wanted to share with you guys the type of jack @$$es there are in this industry.
 
In their defense, I think Adco may have been doing some kind of staging for Alfield (they are part of Martinrea). He may be getting crapped on too. But if I were in his shoes, I would see that we're partly at fault at the very least and would either excuse it or take my lickings on it.
 
That who the job was for. So in there defenow taking 275$ of a $300 bill is justified by your logic on an ltl shipment?

I don't think anyone was getting crapped on more then happy to redeliver at my expense.

Everyone seems to have the same experience with "I am Sam I do what I want.
 
Totally agree with what your angle is Paul, people like that need to be kept in check, but maybe instead of lawyers and all the time wasted with that, take a trip up to see him face to face if he's within a decent distance of you, people will change their tune very quickly when your standing in front of them opposed to being an arrogant prick through email or on the other end of a phone, unless of course the person stands 6'8 then you may have a problem but that's all part of the fun. I collected
from a guy in Cambridge a couple years back , on the phone he thought he was Mike Tyson but when you show up knocking on the door he had no issue signing a cheque for the amount owing.

Sam from Adco has called and apologized, he stated my bill will get paid. Thanks for the input all seems to be good as of right now.
