Hi i need advice on this broker as they booked a load with me picking up on Sunday out of OHIO and the appointment was set for Sunday at noon. My driver was there on Saturday waited all day till Sunday morning to get loaded at 8 am he found out the pick up no he has that load going to some place in US instead of coming to Canada
So called broker and they said its a pickup no mix up but we do have a load to Canada will get it sorted out.

Then another US truck showed up at shipper with the same pickup and got loaded. then the broker emailed me saying it was an Honest mistake from customer end and there is no load for Canada. So they said they will pay me $200 CAD as TONU and that will be all.

I had 100 miles deadhead to shipper then 350 miles to yard empty total of 450 miles. So what are my options here as my driver came back empty and i have a Empty ACI manifest just to prove that we did came back empty.

How much the broker is liable to pay here just need someone's advice as per Energy $200 is the best they will pay

200 tonu is good, ive worked at places that would just get all the dispatchers to offer 125.00$. Some places dont even pay tonu.

A reputable broker, when faced with a situation where his customer cancels a load for whatever reason, should pay something to the truck he had arranged. Running the empty miles to pick up the load was your decision, and the distance back to your home base will not be reflected in the amount you receive for the cancelled load. That said, something between $150 -$250 is reasonable. Certainly if cancelling loads becomes a habit, it would probably be time to change freight brokers, regardless of what they pay for TONU.

BTW THEY ARE BASED OUT OF MTL. ITS THE SAME SCHEME AS TRAFFIC TECH, TITANIUM, COYOTE, DELMAR ETC, ALL REGISTER OFFICE IN IL

Yes they are based out of Montreal and they don't seems to be much experienced as this is the second time i got in trouble with them as they says things different than what they do.

Now i have to pay out of my pocket for somebody else mistake so to me $200 doesn't seems fair but it is what it is
 
@Trans when you negotiate with a broker or customer on a load that you might end up on short end of the stick you need to add in your TNU and deadhead as a separate amount so if things go sideways you are not in this predicament. Front end work always saves you headaches on the weekend. I agree with above comments they are being fair to you.

It was his decision but based on a contract. Your damages far exceed 200 and you should have the right to pursue the carrier for more than 200.

i asked my broker about more money and there manager is on vacation
So we will see when he come back
 
I know hindsight is always 20/20 Trans, but when you are booking a weekend or after hours pickup, TONU charges really need to be discussed at the time of booking (and clarified in writing). If everyone knows them in advance and all parties are comfortable with them you avoid future stress. We put this in practive and also advise the cusotmer at the time of booking "this is a weekend pickup, should the truck not be loaded as agreed, $xx TONU charge will apply."

Yes Mike you are right but i never thought about this that it could end up like this
In weekday we don't even bother for TONU if broker realise there mistake. So i have learned the hard way i guess.......
 
The original poster didn't mention anything about a "contract" Henry. If a carrier wants the load and decides to run 100 empty miles or 1000 empty miles to get it, that is his decision. If the broker had offered him a premium to drive those empty miles then yes, that would be a different scenario and yes, additional monies should be added to the TONU. As there was no "contract", other than a standard load/dispatch sheet, the carrier is only entitled to a standard TONU. I am all for being fair and reasonable, but compensating someone for what turns out to be a bad business decision, isn't the correct course of action in my opinion.
 
I think that we can agree that every situation differs and there will be a lot of things to weigh.
How much business do I do with the party I'm negotiating with (if after the fact)?
Who caused the issue (should be most accountable)?
What information was discussed at the time of booking (eg. I'm running 200 miles)?
What is fair for everyone involved, is it possible that everyone comes away feeling the negotiation was fiar and reasonable?

Funny, I've not previously mentioned a situation that I found myself in. A carrier was rejected loading a half load becuse the shipper/importer neglected to advise anyone it was a food ingredient and needed to move exclusive use. There's a lot of details but the important ones are that the carrier ran a bunch of miles to the WY shipper, they also arrived 3 days late to load. I made what I felt was a fair offer of $500 TONU charge all details considered and the dispatcher demanded no less than $1000. They even posted a google review on my employer that has horrible grammar about how badly they were treated. I found out who the owner was and called him on his cell phone. I asked him to review it and said that I was prepared to honour the $500 offer. Never heard back from anyone and could care less about the review.

I've rambled enough, in the end like I said and many others will agree every situation is unique but a straight forward TONU for LTL is $50-$100 and $150 for TL, in my opinion.
