My quick response, why would an employee allow their statement of non paid overtime go for so long? Not sure if Canada Cartage drivers are union or not? But again, you would think that if in the first few months the employer wasn't paying correctly the drivers would speak up immediately? But again, not familiar with who run the show at Canada Cartage.

For having lived through the same problem, I can say that often, people just change jobs. When I started to talk about the problem, I was given a lot of grief. All of a sudden my schedule changed, I was getting more and more 1/2 days, shifts cancelled at the last minute etc... The thought of going after them for the money was daunting. The big companies have much more clout than the common employee and it just takes soooo much time and energy. I eventually thought it best to just find another job and move on.

This is likely the first of many to be filed given that a large number of carriers are guilty of withholding or not paying their drivers overtime as per the laws of the labour code.

Well considering many of 'those companies' are charter members of the OTA and CTA....
You tell me why they're not following the law...

Canada Cartage employees should have addressed their issues years ago with the company.
Waiting until now ... with a 100 million class action lawsuit, Canada Cartage will probably close up.
So now the employees will have no job.
Canada Cartage can open again under another name ...
Moving to another company does not address the issue ... leaving the issue too long makes it worse.
How much does the lawyer make in this deal for his role ?

This suit will likely be settled out of court. Canada Cartage is too large to let this be a PR disaster. And that is basically what it is....
The case must have some merit to it - and the fact that it is a "class action suit" - quite a few people involved in this one. It will be interesting to see in the next few months how this pans out....

4th hand and probably only 50% accurate so don't quote me on this:
Huge amount of employees were let go only to be replaced by 'employees of lower wage and caliber'. I've a feeling it's not current employees in the lawsuit so much as 'past employees'.
I really hate to contribute to gossip, but I figured, meh.

Just my opinion, but I believe this was probably initiated by a lawyer looking for a huge cut of any settlement, as opposed to a herd of disgruntled employees walking in to a lawyers office.
As our civil litigation system becomes more Americanized, lawyers are getting friskier and riskier, heck just check out some of their advertising. I'm not saying the whole thing is with or without merit, I'm just giving my opinion as to who I think inititated it.
And I agree, if any likely settlement is too huge, they'll just pack up and restart as someone else.
