Contact your insurer and the carriers insurer. You need to turn up the heat in any possible way. Perhaps a letter from a paralegal demanding delivery and spelling out payment terms. Crooks get away with this nonsense because the victims usually don’t push back.

True enough, but if things escalate, especially into Small Claims Court, it has been our experience that evidence of a demand letter being sent to the delinquent party will be required. Who knows, small inexperienced crooks just might fold when presented with a well documented, threatening demand letter all by itself. In any event it is a step that should be taken in the collection process.

Anyone have copy of Sim Freight insurance. FMSCA shows theirs was cancelled in October 2022. We can't find our copy and insurance company is denying claim as the say insurance lapsed in January 2022?

It is a good idea to be a named certificate holder on the carriers insurance policy. The most important part of that is the insurance company has to notify all certificate holders if the policy is being cancelled. I know in this case it is after the fact, however going forward it is a good policy. It also might be a requirement of your own insurance policy indicating that you perform due diligence when hiring carriers.

not exactly. on the COI it also advises that if they fail to give notice they impose no obligation or liability.

I wasn’t implying that being a certificate holder would grant any special status or recourse in the event that a carriers policy lapsed or was cancelled. Just that you would be notified if the policy expires or cancels. Of course insurance companies are experts at covering their butts, the only thing they are better at is saying “no” to any question regarding their liability.

If the insurance was cancelled Oct 2022 then it should have been in force in Jan 2022. Maybe you're referencing the wrong policy? Look here for the correct policy number for the time period.

We had to send a power unit to get our 2 trailers back from them when we finally found them.
