Vpa group mississauga

We haven't dealt with them in months. John formerly of BREST went there and gave my dispatch a cpl loads. Had to chase them for the $$ so I cut them off.
 
There is a very fine line when it comes to that kind of stuff Krazysilk. Yes they can report it stolen. If you are holding freight that is unrelated to your past issue then yes you can be charged with theft and extortion.

If you pose "bad credit" and "negative reporting" as the justification for payment up front - there is not much the customer can do about it. Those that have bad credit tend to KNOW IT - and they have no answer to come back at you with when you do make their freight COD.

Stand your ground - especially with this account.

That works in that type of situation, but you cannot take another shipment and use it to demand payment for a past shipment that has not been paid. It doesn't work like that. People do try it and have been successfull at getting their money but they are lucky that they were not reported to the police.

krazysilk - You can hold the freight you currently have on board on a c.o.d. basis, based on your past experience with them as late or non payers. Jessica at X West is correct in that you could be charged with theft and extortion for holding it to get payment for you other older invoices with VPA.
However - if the amount they owe you isn't huge - and if they don't want to risk losing a customer, and if they have any intelligence at all - they may just pay you instead of calling the cops. If they do call the cops, you can tell them that it's a commercial dispute, and you can tell the cops exactly where the freight is being held, and they may tell VPA to go to court as it's now a civil matter.

It's a crap shoot at best - but what better way to test your nerve?

You might as well make things as hard on them as possible, first call EVERYONE listed on the bill of lading, and explain your situation. Second (if this was U.S. freight) call the D.O.T.and M.T.O. if they are not a licensed broker with a surety bond things will get a little uncomfortable for them. The last thing you have already done, which is spread the word, and this site is amazing for that.

Jessica/Howard - thanks for clarifying that for Krazysilk.

You can only hold the current freight for payment and NOT for past freight in which receivables are still outstanding.

I agree with both your comments - this scenario gets tricky very quickly and best to avoid it all together if you are not experienced with this. You run the risk of the broker "dumping" the freight when you make it COD. You are then left trying to figure out who owns it - and who is going to pay for it.

If You hold they're Freight Hostage...they can call the police all they want....police won't do a dam thing about it....authorities will call you...you simply say freight hasn't delivered yet ...I am owed Money...they will go back to plaintff and say it's a legal matter call your lawyer...this can take months...possession is 9/10ths the law...Hold your ground you will get paid...no worries! I have done it several times....Dont be scared....be more scared of loosing your money!!!
 
Sorry Flat Bed but you are wrong. I won't go into to too much detail but the carrier that chose to try that with me had 1 hr to deliver my freight or be charged with theft and extorsion.

Very interesting, why did the carrier choose to hold your freight? Not paying your bills? C'mon now, there had to be a reason????
 
thanks every one for your input, well i really don't think, they will give any freight, but if they do ,i will pick it up and call them and tell COD, but i think i will call everyone starting with JWService and see what happen, i will update on this matter everyone and PLEASE BE CARE FULLY WITH CLOWNS,,, IS ONLY $550,

Mrspeed, obviously you are not familiar with the company I work for as you would not pose such a question. Yes we pay our bills. There is an issue far bigger that prompted such a situation. I do not wish to disclose such information publicly as it has become a legal matter.

Krazysilk. I wouldn't do this, two wrongs don't make a right and it's bad business practice nevertheless. Just press them for your money. I'd even show up at there office and stir things up. If all else fails send it to collections.
