Having an issue with a carrier holding freight of one of my clients for a payment cut back from another 3rd party.
I have nothing to do with either issue but the client I have been contracted by to move the freight was one of the shipments this other 3rd party cut back the invoice on.
I am being told that the trailer will not be released until the 3rd party pays them their full amount of the outstanding invoices.

Anyone have any input on how to proceed with the holding of freight?

First of all they can not hold your freight for back payment. They can ask for the cost of moving that load.

I had this happen to me and they called the Police on me. I would suggest that you contact the company holding your clients freight and offer to pay them for moving that load only. If they are not co-operative with you, then tell them you are going to get the Police involved. Normally they back away from getting the Police involved.

If nothing gets resolved, then I would contact the Police and explain that they are holding your clients freight as hostage.

To further complicate , the carrier is based in Montreal with an office in Mississauga and the 3rd party is based in New Jersey with an office in Mississauga.
Both owners are standing fast and the 3rd Party suggests I call the police. My client wants to have us call the police and have the carrier charged but as a 3rd Party , do I have authority or would the customer, owner of the goods, be the one that should call the authorities?
I appreciate your help, been in the industry for over 30 years and have not run into an instance where someone is holding contracted freight with no direct reason to.
 
They have no right to hold you for ransom on this. This is why US brokers have carriers sign contracts. One of the main things in the contract is each holding the other party harmless.

I'm not sure what you can do about it at this point though.
 
Short an skinny, Police will do almost nothing except take notes and tell everyone to deal with it in the court system, It's what they call a domestic dispute. Until then your freight is hostage. We had a PQ carrier do this a number of years back with a load of new golf carts they improperly loaded and scratched up. Demanded payment before they came off the truck even though they caused the damage. Took lots of pictures, payed the price and was able to get recource in the court room 6 month's later. Yes holding freight for a previous shipments freight bill is illegal, but still hard to enforce. Lots of luck with this, Pay the price get lots of pictures even of the driver, intimidation will make them nervous and possibly slip up or have second thoughts before you get to court with your claim.
 
Update*** Negotiated an amount with the carrier, the customer hand delivered certified cheque and arrangements made to have trailer there for Thursday 8am. Driver arrives and my contact's partner loses his cool and tells driver he is suing , doesn't appreciate being extorted and threathens not to pay. Driver pulls trailer back to yard , carrier now wants $250.00 per day storage, our money up front and additional $4300.00 certified beford he will bring the trailer back . Scrambled , played referee, mediator , Dr. and provided all parties with what they needed and trailer dropped in dock this am for offloading.......

Trailer has a leak , product in the nose is wet!!!!!!!!!!!!!!!!!!!!!!!!!!! ARRRRRRRRRRRRRRRRRRRRRRRGHHH.
 
Unfortunately, if a claim results from the water damage, you won't have this crook out of your life just yet. So far, I think you have handled the situation as best as you could considering the position you're in. If no claim results, have a stiff drink, shake your head to get the memory out and get back to business as usual.

Unfortunately due to the nature of the situation I am hesitant to relay the name of the carrier involved ( I would love nothing more to dragging them throught the mud !!) but have to show restraint on a public forum. Not quite sure legally how Libel works.

It is interesting that you have been using this carrier for the last 5 years... or at least you did your due diligence on them and it was fine. And used them...

So, I hate to be a devil's advocate here but they can't be that bad!
Also, this kind of behavior really only happens when somebody is trying to rip off a carrier in a very unprofessional way. The gloves come off.....
I believe before we completely discredit this carrier, more details have to come to light to make a sound judgment. Presumed innocent until......
Do I support this kind of leveraging of power? Most certainly not. But, having been in this kind of situation with a dishonest shipper I know the predicament personally. So, I sympathize....
I never had to do it in the end, but the thought was there!
What if the loader damaged the product and punctured the hole in the trailer while loading.....never informed the driver. Then, when cornered about it you hear lies, lies, and more lies....

No my freight wasn't held but the author (much like you) was afraid to out the scoundrels and I was told in private so I could do it it for them so everyone could know.
 
I am just so happy that i am not the only person it happened to. I disagree what the carrier did in this case also.

New Century operated under a few different names. He kept using E Economy finance to factor. I ran into him a few times where i used to dispatch.
