Can anyone verify the following:

You do not have to be a US Bonded Carrier to carry goods into the US under a T.I.B.; BUT YOU MUST BE BONDED to return goods in Canada.

Correct or Incorrect?
 
My impression is that is 'incorrect'.

In order to have a T/E or TIB created by customs/customs broker, you would have to have a US Bond for it to be associated to.

I am also interested to see what others have to say about it, but i would think you need to be US Bonded in order to have freigth travel In-Bond through the US.

I agree with boss on this one. The only way I could see you taking it into the US without your company being bonded would be for your company to be named and authorized by the bond holder to transport the goods. The bond, I assume, could be held by either a carrier or the importer of record. I'm not sure if an importer can set up a bond and specify which carrier will haul the freight. The difficulty in that would be that if the importer doesn't export or destroy the product as is required in the legislation, would the carrier on record be liable for any of the charges associated with the shipment? That is where you might have troubles.
 
When applying for a TIB with US Customs you are required to provide a US Bond number. This bond number must / should be cancelled when the freight leaves the US. Some carriers allow 3rd parties to hold freight on their TIB. I suggest you have the bond cancelled at the time you release the freight. Most exporting companies want you to leave the bond in place and advise they will cancel the TIB for you. If you decide to do this make sure you follow-up to ensure the bond was cancelled. Major fines can be levied against the bond holder if TIB's are not cancelled in a timely fashion.
 
TIB bond

Previous to the requirement of an ACE manifest, we did carry freight to shows using a TIB bond although we are not US bonded.
Invariably the shippers were stuck and could not find a bonded carrier to carry out the move.
We always picked up the bond from the shippers customs broker. We did this on several occasion using more oftan than not using Affiliated or A.N. Deringer as per our clients instructions.

I doubt this will work in today's environment with the ACE manifest!!
