Hello, any service issues with Sondh Freight? Gave them a load to pickup at 1pm in Scarborough, deliver before 3pm. "Yeah, he's 10 minutes away".
Calls now asking if it has to deliver today because he just picked up now.
Hoping this is a one-off...
 
basically the order to pay is not enforcable - this is what I gather from the article. So carriers who pay their bills and their drivers cannot compete with carriers that dont have payroll expenses I guess

The question is are these workers actually employees or were they DRIVER INC.?

In regards to enforceable, the reality is that you can win in SCC and get the defendant slapped with an order to pay but if they don't respond you will have to get a lawyer to petition the court to move forward with other means either through garnishment or liens. If the defendant is a company who owns nothing then it is a hard long uphill battle to get the courts to apply this to a director of the company. Even if you're successful there then you start over with trying to get the funds from a director who may have hidden his money away.
 
Yes, Sondh will have to pay. I can only assume they felt these workers would just find other employment and write off the losses. I guess they were wrong.

Yes, to a degree, but that will depend on what contracts were agreed to and how the courts will interpret them. What did the contract say about payment? The Truck News post says that a judgement was found ordering SONDH to pay in respect to one of the situations, but the post doesn't say anything about employment status/Driver Inc. or if there was even a defense on behalf of SONDH.

Since we don't have this information let's say for speculative hypothetical purposes that the contract says that all BOLS must be legibly signed and handed in. If the Driver Inc. didn't hand them in or the BOL is not legible it is subject to interpretation and in a dispute eventually a court will have to decide if the two parties cannot agree and one finally pushes it to court.
