Interesting how you compared the construction industry to transport.

Another advantage contractors have on us in transport is the builders lien. I do not know if it exists elsewhere in Canada, seeing we do not practice common law here in Quebec.

In case the contractor feels a threat of non payment from his client, he has the right to lien the property.
Naturally, no deed can be completed while the lien is in place, forcing a quick settlement.

Well alx, I made that comparison because I worked as a carpenter, then a construction superintendent for 30 years before getting into trucking.

Construction liens are part of the law in most jurisdictions, Ontario's is : Construction Lien Act, R.S.O. 1990, c. C.30
Consolidated Statutes of Ontario.
It really is a law practice specialty. Generally, a contractor has 30 days after he/she last worked on the site to perfect their property lien. The owner has the option of paying security into court (claim + 25% for costs), in order to dis-encumber the property to facilitate progress draws against the mortgage or trade the property. It then gets handled similarly to ordinary litigation. There is also a 10% hold-back until 30 days after substantial completion. The 10% is the limit of liability the owner has to 3rd. parties (sub-contractors).
It is a well established protocol for governing these non movable property issues.

The bottom line is that for transportation service users, it may be beneficial to establish similar protocols for releasing payments to carriers or brokers to protect from having to pay twice.
 
billing the shipper

I am sure alot of the money owed would be freight for signature in Pickering. Anyone had any luck in billing them?

Signature Aluminum in Pickering in itself is not in too good a shape. Maybe this has to do with RBL going down?

I used to do some work for them ... but volumes just go down and down .... and they close plants. Can't be very good.
