Heads up!

This carrier filed for Chapter 11 insolvency (reorganization, not liquidation) in August and is still operating. In July 2024, we filed a claim for a shipment of romaine lettuce that arrived frozen. Both the reefer download report and USDA inspection certificate confirmed inconsistent temperatures. In October 2024, the claim was denied by their insurance company as Ray's lacked insurance coverage. Despite our request, Ray's has refused to provide the insurance denial report and has been uncooperative, unresponsive, and hostile.
 
Assuming you set them up and got a copy of their insurance certificate including cargo, it lists the insurance broker and the underwriter plus the policy number, Call the broker that issued the cert and find out who is handling the claim.

If this was a reefer breakdown or malfunction they might not have Reefer Breakdown coverage. I will assume you are a 3PL and you have your own contingent cargo / error and omissions policy, I would notify my insurance broker and get an adjuster to start working on it.
 
Hi! Yes we did have a copy of their COI. It provides for motor truck cargo insurance which includes reefer breakdown. Single coveyance is 250K. It says it was in effect from January 1st 2024 to January 1st 2025. This is what the adjuster said:

We do not show coverage for the claim. I sent all the policy/denial details to the insured. They can provide the reasoning and letter. I cannot provide their policy information. Please reach out to them for more information. Thank you!!

We are a 3PL and have our own insurance, however, I don't understand why their insurance would deny coverage. Ray's is not providing us the reasoning, nor the letter.
 
Any chance their policy was canceled or changed and your were not notified?

I would definitely get my own adjuster on this, they might be able to use their industry contacts to find out the reason.
 
That's what I'm thinking that they cancelled their insurance and we were not notified.

Hi, I just wanted to let your know Ray's ended up paying the claim amount out of pocket. Appreciate your help on this!
