The first meeting is to receive the trustee's prelimary report and vote on an unsecured creditor representative called an inspector.
If you are owed money by Loft, you need to try and determine if the shipper/consignee paid Loft prior to the date of the bankruptcy. If they had, you may have a claim in small claims court against the director(s) of Loft.
If they have not, and the trustee collects the money, you may have a claim against the estate; however, it appears that notwithstanding the trustee's past knowledge of case law, he will follow the BIA act in treating unpaid carriers as unsecured creditors, ignoring the TCT Logistics and Nadiscorp court decisions. Could prove costly as trustee would undoubtedly seek court direction.
