Groupe Robert forced to reinstate truck driver fired for drinking and driving

Seriously hope the appeal goes in Robert's favour. i understand the technicalities of what they should've done but for the safety of everyone get this lady off the friggin road and out of job as a trucker.

Really and what will their insurance company have to say about it. These courts are out of their freaking minds and the Teamsters are no better, i get they have to stand for the members but chickie poo through that all away when she cracked the first one in the cab at work Immediate dismissal as there is zero tolerance for drinking and driving especially in a class 8 truck.
 
This person is extremely lucky. Imagine for a moment if she had crashed into a school bus full of preschoolers, resulting in multiple deaths and injuries. There would be no discussion about being reinstated as a driver for Robert again, as the rest of her life, or a good chunk of it would be spent behind bars. This case has a strong chance of being overturned in my “non legal” opinion. The arbitrator seems to suggest that the company should have been asking this employee, and maybe all employees, if they have an alcohol problem. Hmmm….I am not too sure how many would respond in the affirmative. Also, could it not be construed as an invasion of the employees privacy to be quizzed about their lifestyle choices? Lots of weak links in this decision.
 
This is where common-sense needs to come into play.

Regardless of what technicalities they exploited. This woman decided to drink 9 beers while operating an 80k lbs weapon.

I agree but she advised the company a week after she the accident she had a drinking problem. This makes no sense. I could understand if it was a week before and Robert did nothing but a week after they are being seen as cold hearted! I hope they win this appeal.

right. which now means the company has to do their utmost best to help the driver. its ridiculous but this is the rights we have in Canada

Regardless if the disease is cancer, alcoholism or drug addiction, you can’t fire someone just because they are sick. That is the “technicality” at play here. However, in this case the company didn’t know the employee was sick until after the accident and even if they had asked the employee prior to the accident if there was an alcohol problem requiring attention, who is to say what she would have answered.

so I can be a cleptomaniac and work at a bank - and cannot get fired....
Makes no sense ... having a drinking problem means you cannot work as a commercial driver - so need to find an alternate job / where if you fall of the band wagon it will not kill people

they can resassign her / but if the only position available is that of a driver - they let her go
