Freight held Hostage?

Hi I need help with something here please?... Gave carrier 2 hours to pick up something that was about 4 miles away. They couldn't get there on time, they actually got there a few minutes after the shipper closed (so they say). The next day they picked up my freight then called me at the end of the day saying they wanted a mis pick because they attempted to pick up the day before but were unable to make it.

My question. Is this fair practice with a trucking company? I am all prepared to pay a mis pick if I screwed up and sent them to the wrong address or the customer cancelled and the truck was already on the way, etc etc. Reasonable mis pick requests.

Should I have to pay a mis pick because the carrier did not make it to the pick up on time? Even though he had his 2 hour window?

In no way are you responsible to pay a miss pick. One - they showed up late. Two - they picked up the load the next day. Worst case it would be a layover, but still you are not responsible for that as they showed up late. As long as the times are on your confirmation and instructions - you are not liable for a miss pick. IN MY OPINION.

It is a local company that they use for their pick ups though they themselves are located in TO so no layover would have been involved.
 
Then there should be no extra charges as they are the ones who were late picking up. Looks like they are just trying to find ways to make extra cash
 
I don't see how they would be entitled to a mis-pick for this. If they knew at what time the shipper closed and couldn't make it on time, there should have been some conversation with you BEFORE the problem happened. This would have allowed you to contact the shipper and discuss whether they wanted to stay late and load the truck or have the truck come the next day instead, etc.
 
Agree with everyone, absolutely no miss pick, as long as they know the times, they are responsible for meeting them, they had a 2 hour window and only 4 miles away??? They should have communicated prior to closing, as Chica says they may have stayed a little later.
 
Well he called me at 5:59 to tell me the truck was stuck in traffic and might not make it, then he called me again at 6:29 and said they missed the pick up because the shipper closes at 5 although I have email from shipper saying they close at 6. I'm beginning to wonder if I just short pay the mis pick because for me, calling me at 1 minute before 6 to tell me the driver is stuck in traffic is not reasonable follow up.
 
And the worse thing about it is that they haven't got a great rap sheet on this site, though I've never had a problem with them before. This is the first time and it will be the last time because I don't like doing business like this. Its unethical.
