Brokers who don't know HOS rules

Just got a call from a broker, who will remain nameless (just in case this was a one-time-only occurrence), telling me an 800 mile trip can easily be done in 12 hours, including border crossing. I told him this is impossible and he told me that others have done it before and it is possible to do because the driver can drive for 14 hours. I told him a driver can only drive 11 hours TOTAL in the US. Reply, "Oh. I thought it was 14 in the US." After educating this guy that the window is 14 hours but actual driving time is 11 hours he finally understood.
Jeez...........

Oh my...

I wonder if the owner of that brokerage knows that his dispatcher is trying to book a service time with you that contravenes HOS. That would implicate said broker if for some reason your driver got into an accident and killed a pedestrian for example, especially if the accident was caused by 'fatigue'. I'd go on about my thoughts on lawsuits in the US but that's a whole different thread.

I hope that dispatcher takes the time to speak to their supervisor and that they decide to re-educate the whole team (assuming it's more than a one man broker) regarding HOS.

Good thread, nice topic.

Keep well,

Mike

Mike, that scenario seems familiar with something that happened last year with another ( hopefully ) broker.... :)

Just saw that the load is now posted on Load Link. Tilbury to AL for anyone who is interested in knowing the broker....

Did you explain to the broker that they had called a trucking company and not an airline?

800 miles in 12 hours of driving even if you negate the border crossing is still really quick>especially in a castrated Ontario compliant truck!

Did you happen to mention a loaded truck only averages 55 mph? Ask him if he takes bathroom/meal breaks. Does he drive 80 mph in snow storms? We all found out this week, the storms in the states have closed roads, caused power outtages, and shut down airlines, let alone the drivers held up for hours on end.
I'd call him back and tell him to go talk to his safety department. If he walked into my office....he'd be leaving with an ROE in hand.

I couldn't check that of course, we are a broker (only). I would however love to know not the company name (I also wouldn't generalize based on interactions with one induvidual) but the full name of the dispatcher (so I never hire them to work here in operations).

For those of you attending the DNA dinner/seminar tonight. I'll see you there, please drive safely!!

Keep well,

Mike

Acting as a devil's advocate, they've probably had experience getting it done before and don't understand why it's not a 'kosher' trip, for lack of a better term. Sometimes people become accustomed to an expectation which really isn't fair. I actually think it's probably not ill-intentioned.

Maybe the person was getting confused kms and miles. Just saying:confused:

Anything is possible I guess but in this case it is highly unlikely. After completing the math and HOS lesson, he conceded that maybe it wasn't possible to run 800 miles in 12 hours.
