Provincial Employment Law states that employees have to take their minimum two weeks holidays. If they want to forgo the time for their pay - you require the approval from the ministry.

Foregoing Vacation
An employee can give up some or all of his or her earned vacation time with the employer's written agreement and the approval of the Director of Employment Standards. This approval does not affect an employer's obligation to pay the employee vacation pay; employees may give up vacation time, but not the right to vacation pay.

We have been through this as well for employees who want the money and not the time off. Yes, you are correct in how the law reads.

However - the reality is that as long as you have a letter signed by the employee where they are requesting and agreeing to vacation pay in lieu of vacation time off - there is very little chance of any recourse by the employee or Ministry of Labour. But I guess in today's world there is always a chance.

This was told to me by someone in the Ministry of Labour.
